Public management of subsurface use in Russia (years 1992 to 2004 - action of the "two keys principle")

Abstract: 

Constitution of Russian Federation and Law of Russian Federation "On subsoil" defined basic principles on the relations of the subsurface use regulation's formation. Questions of subsurface use public management during the principle of "two keys" (from 1992 to 2004) existence are considered. This showed its efficiency and discrepancy. One of bases for receiving right of subsoil use on specific sites was a joint decision of federal governing body of the state fund of subsoil use or its territorial body and executive authority of the appropriate subject of Russian Federation, adopted as a results of competition or auction for investigation and mining of subsoil located on the territory of subject of Russian Federation. In year 2004 powers of executive authorities of two levels were differentiated: federal and regional (subject of Russian Federation). These years experience made it possible to change legislation in the sphere of public management of subsurface use.
